("rPath") joint ownership in all worldwide common law and statutory rights associated with the copyrights, copyright application, copyright registration and moral rights in Contributor's changes and enhancements (the "Contribution") to the Conary distributed software management system and associated software (the "Software"). This assignment applies to any future Contributions to the Software hereafter made by Contributor, which Contributor also assigns. Contributor retains the right to use the Contribution for Contributor's own purposes. Contributor agrees that this assignment may be submitted by rPath to register a copyright in the Contribution. Contributor represents and warrants that they are the sole copyright holder for the Contribution and that they have the right and power to enter into this contract. Contributor indemnifies and agrees to hold harmless rPath, its officers, employees, and agents, from all damages arising out of any breach of this warranty. Contributor hereby agrees that if they have or acquire hereafter any patent or interface copyright or other intellectual property interest dominating the Contribution, the Software, the Software as enhanced by the Contribution, other enhancements to the Software, or the use of any of those, such dominating interest will not be used to undermine the effect of this assignment; that is, rPath will be licensed to use, in the Software and its derivative works, without royalty or limitation and in perpetuity, the subject matter of the dominating interest. This license provision will be binding on the assignees of, or other successors to, the dominating interest, as well as on Contributor.
